Crack down on production and sale of counterfeits, and intellectual property infringements, public security places 438 cases on file under procuratorate's supervision
February 16, 2005Information from the Supreme People's Procuratorate, in the supervision over cracking down on production and sale of counterfeits, and intellectual property infringements, so as to prevent and correct the problem of replacing punishment with penalty, the procuratorial organization actively reinforced ties with administrative organizations for law enforcement, 649 cases suspected of crime and 820 suspects were moved with suggestion, and 438 cases and 566 people were placed on file by the public security organization under its supervision.
According to relevant principal with the Supreme People's Procuratorate, in the supervision over cracking down on and placing the cases of production and sale of counterfeits and intellectual property infringements on file, the Supreme People's Procuratorate may investigate major cases, determine clues and assign working group to supervise. Cases having big influence nationwide, such as the Anhui Fuyang inferior milk powder case, and the Jiangsu Lianyungang fake chemical fertilizer case have been handled in time according to law under the supervision of the Supreme People's Procuratorate.
We learned that, in order to crack down on the crimes of fake production and sale, and intellectual property infringements, the Supreme People's Court and Supreme People's Procuratorate jointly promulgated “Interpretation on Several Questions in Relation to the Applicable Laws in Handling Criminal Case that Infringes Intellectual Property”; they also jointly signed and issued the Opinion on the Working Contact between the Administrative Organization for Law Enforcement, Public Security Organization, and People's Procuratorate, so that the linking mechanism between the criminal justice and administrative law enforcement had been improved, and system guarantee had been provided to reinforce the effective supervision over moving suspected crimes by the administrative organization for law enforcement, and lawful investigation into criminal liability of criminals who had destroyed the economic order of socialist market.
