According to the recent decisions by National People's Congress,

• Appeals of first-instance judgments or rulings on IP civil or administrative cases involving high level of technicality shall be filed with Supreme Court.
• Retrials and protests to effective first-instance judgments, rulings or mediation decisions on IP civil or administrative cases involving high level of technicality shall be tried by the Supreme Court.

While the Supreme Court may order courts at lower levels to retrial by law.
